Summary of our Terms of Use
You must read and agree to our Terms of Use (the “Agreement”) as it forms a binding agreement between you and Toggl Hire OÜ (the „Supplier“, doing business as Toggl Hire). This short summary is provided for your convenience only (with capitalized terms as defined in the Agreement) and does not state all the terms, conditions, exclusions and definitions within the Agreement. Your rights will be subject to all the terms, conditions, exclusions and definitions of the Agreement as defined by Toggl Hire OÜ.
Acceptance. By using the Service, i.e participating in a Campaign you agree to the Agreement.
Eligibility. You as a natural person Participant shall be deemed to have represented to the Supplier that you are, at least 18 years old and capable of entering into agreements. The same representation is deemed to be made each time that you cause yourself to be exposed to the Service.
Disclaimers. You acknowledge and agree that:
- the Service (a) has not been designed to meet your specific requirements, (b) may from time to time suffer interruptions and be occasionally unavailable, (c) has and will continue to have certain bugs and vulnerabilities, and (d) is provided on an "as is" and "as available" basis;
- the use of any of the Features are at your own risk.
Data Processing. You acknowledge that: (a) the Service allows the Customer to process certain Personal Data about you and other Participants; (b) such information forms part of Customer Data; (c) the Supplier is neither the controller nor the processor (neither "chief", "responsible", "authorised" nor any other processor) of Customer Data and has no control over, nor any obligation in connection with, such data or the processing thereof; (d) any enquiry, request, objection, complaint or claim that a person may have in connection with the processing of Customer Data should be addressed to the respective Customer.
Intellectual Property Rights. All Service-related Intellectual Property shall vest in, and is retained by, the Supplier and its licensors.
Limitation of Liability. We as the Supplier shall not be liable for any undesired consequences, including but not limited to (a) any loss or damage, resulting from your use or inability to use the Service, (b) unauthorised access to, or interruption, alteration, loss, corruption or deletion of, anyone's transmissions or data, or (c) any other matter relating to the Service or any part thereof.
Governing Law. The Agreement is governed by Estonian law. The UN Convention on Contracts for the International Sale of Goods does not apply to any of the foregoing.
Arbitration. The Agreement contains an arbitration clause. You agree that any disputes arising from or otherwise concerning the Agreement or the Service will be settled by arbitration.
